With Australia, there are many things in being a British Colony. That are taken for granted and in reality are more than just symbolic. Our Governor General is our head of state but also the Commander-in-Chief of the Australian Defense Force.

The Governor-General's duties as Commander-in-Chief include:

  • Through Federal Executive Council, appointing the Chief of Defence Force and Service Chiefs
  • Commissioning officers in the Navy, Army and Air Force
  • Presenting Colours, Banners and other Honours to military units and personnel
  • Visiting military units to acknowledge the service of service personnel
  • Leading Australia’s response, celebration and acknowledgement at commemorative events.

It is to the crown that our defense force swears an oath. Not to Australia, its people, or to the Australian Government but to the Monarch.

Armed forces

The oath taken by a member of the navy, army or air force is:

I (name), swear that I will well and truly serve His Majesty King Charles the Third, His Heirs and Successors according to law, as a member of the (insert Royal Australian Navy, Australian Army, or Royal Australian Air Force) ... and that I will resist his enemies and faithfully discharge my duty according to law. SO HELP ME GOD!

The affirmation:

I, (name), promise that I will well and truly serve His Majesty King Charles the Third, His Heirs and Successors according to law, as a member of the (insert Royal Australian Navy, Australian Army, or Royal Australian Air Force) ... and that I will resist His enemies and faithfully discharge my duty according to law.

All members of the Australian Parliament and also our Head Of State the Governor General also swear an oath to the crown. Here is the Governor General's oath.

Oath of Office

Upon taking office, a Governor-General-designate is required to take the above Oath of Allegiance as well as a separate Oath of Office, in the presence of the Chief Justice or another Justice of the High Court.

I, (name), do swear that I will well and truly serve His Majesty King Charles the Third, His heirs and successors according to law, in the office of Governor-General of the Commonwealth of Australia, and I will do right to all manner of people after the laws and usages of the Commonwealth of Australia, without fear or favour, affection or ill will. So help me God!

Our police force in various states also swear their oath to the Monarch.  This is NSW's which I believe is still current.

POLICE REGULATION 2015 - REG 7

Oath or affirmation of office for police officers

7 Oath or affirmation of office for police officers

(1) The form of the oath required to be taken by a police officer under section 13 of the Act is as follows--

I,, do swear that I will well and truly serve our Sovereign Lord the King, His heirs and successors according to law, as a police officer without favour or affection, malice or ill-will until I am legally discharged, that I will cause His Majesty's peace to be kept and preserved, and that I will prevent to the best of my power all offences against that peace, and that while I continue to be a police officer I will to the best of my skill and knowledge discharge all my duties faithfully according to law. So help me God.

Everybody is swearing to cause His Majesty's peace to be kept and preserved. So for me, when there appears to be systemic corruption. I feel our corruption is the King's corruption. The British throne is a den of thieves and far worse when there are stories like this. Our Head of State does nothing and says nothing. So they are the King's representatives and in the name of the King. The cover-up continues...

Here is a counterargument to what some consider has become a conspiracy theory in regards to. Comments by Senator Heffernan alleging 28 High-level pedophiles including a former Prime Minister.

Part of the argument in the link is that it was a matter for the police and outside the terms of reference for the commission even thou it was police documents surrounding the list that was handed to the commission. Of course, arguments will go round in circles but looking at the Fitsgerald Inquiry. It set a precedent for the terms to be able to be extended and ended up with criminal charges being laid. It often feels in Australia investigations are hobbled by the terms of references given to a Royal Commission. One could possibly use the precedent of the Fitzgerald Inquiry for further investigations but of course, it seemed nobody wanted to do that.

Obviously, a list of 28 alleged pedophiles seemly given by police did not invoke the moral authority of the QC to extend the terms of reference. At the time and in my opinion. What a useless QC in a Royal Commission on behalf of victims, Her Majesty, and the people of Australia he was.

Fitzgerald Inquiry

The inquiry resulted in the resignation of Queensland's premier, Joh Bjelke-Petersen, the calling of two by-elections, and the jailing of three former ministers and the Police Commissioner Terry Lewis (who also lost his knighthood).

While the terms of reference were initially narrow, restricted only to the specific allegations raised against specific persons named in the media over a period of just five years, Fitzgerald used his moral authority to expand the inquiry to examine any relevant matter. As a result, the terms of reference of the Commission were extended twice.[1]

That enabled Fitzgerald to set a precedent for commissions of inquiry and Royal Commissions in Australia generally

Moral Authority

Moral authority is authority premised on principles, or fundamental truths, which are independent of written, or positive, laws. As such, moral authority necessitates the existence of and adherence to truth. Because truth does not change, the principles of moral authority are immutable or unchangeable, although as applied to individual circumstances the dictates of moral authority for action may vary due to the exigencies of human life.

The phrase has also been used in Australia to describe the situation when the head of a Royal commission expands the subjects being investigated, beyond the narrow focus of the commissions terms of reference.
